    That community is already in the process of dissolution where each man begins to eye his neighbor as a possible enemy, where non-conformity with the accepted creed, political as well as religious, is a mark of disaffection; where denunciation, without specification or backing, takes the place of evidence; where orthodoxy chokes freedom of dissent; where faith in the eventual supremacy of reason has become so timid that we dare not enter our convictions in the open lists, to win or lose.

        The thread title is the issue. No one cares about the Constitution anymore, only legislating from the bench. On BOTH sides. Another wonderful legacy of FDR.

          When did "legislating from the bench" begin, in your opinion, and with what cases? Explain the faulty rationale.

            Oh, there is no doubt about this being true, and it took me a long time to get there. Thankfully, I didn't have to deal with middle schoolers to achieve it.

              What's so funny about most of those claims- they are laws being overturned by judges appointed by the same party that wrote the laws.

              And at no point does anyone want to consider that the laws that are being overturned are, in fact, un-constitutional. They just want the rule of the masses to over rule the rights of the individual. Duh. And then they demand that their amendment get zero anything applied to it. Duh, again.

                  Creating entirely new "rights" in Heller and McCutcheon was just fine for the ahem "strict constructionists."

                  It's just a partisan fig leaf. The interpretation of the law is, unavoidably, politicization of the law. The only difference between conservative and liberal judicial activists is the former wrap their agenda in hypocrisy.
