    It's within the Executive's authority to investigate a possible violation if they so choose, but they would only have authority to prosecute if an investigation found such a violation had likely occurred. You apparently (despite almost no knowledge of what was said), had decided that standard had been met. Further emphasized by your next statement: "Mr Kerry should not be doing that." You clearly decided he had done something improper with very little to go on. You are a hypocrite.

        The folks running Executive right now would "ready, fire, aim".
        They'd start a prosecution without having done the diligence (the investigation).

        Back to my question: Should Citizen Kerry have been talking to the Iranians. I believe (my opinion) US citizens should not be talking to foreign representatives about US policy (hence: investigate). If they were sharing cookie recipes, great! Can I get a batch?
